What should the law be? That brings me to the normative question: Current law aside, what should the law be? Should Congress amend the Stored Communications Act so that providers can litigate the constitutionality of an ECPA warrant before executing it? I think reasonable minds can differ on that, so I thought I would run through the arguments on both sides.
